Storrs v. Holcomb
645 N.Y.S.2d 286 (Sup. Ct. 1996) (appeal dismissed, 666 N.Y.S.2d 835 (1997)).

Facts: Two men sought a marriage license, and when the license was denied, sued (representing themselves in the beginning), against the recommendation of other proponents of same-sex marriage.

History: The trial court held there was no constitutional right for the plaintiffs to marry. On appeal, the Appellate Division dismissed the plaintiffs' complaint for failure to join the state Department of Health, a necessary party. The plaintiffs filed a new complaint which was dismissed on procedural grounds.

Current Status: It does not appear that the case will be refiled.
