Amendment

Initiative Measure 416:

Only marriage between a man and a woman shall be valid or recognized in Nebraska . The uniting of two persons of the same sex in a civil union, domestic partnership, or other similar same-sex relationship shall not be valid or recognized in Nebraska.

• The amendment passed by a 70.1% to 29.9% margin, with 477571 votes in favor and 203667 opposed. The measure received majority approval in each of the state's 93 counties.

On May 1, 2003, the ACLU of Nebraska and Lambda Legal together filed suit in United States District Court for the District of Nebraska, arguing that IM 416 unconstitutionally denies gay and lesbian persons equal access to the political system.
